Acceptance of Terms<\/h3>\n<p data-start=\"243\" data-end=\"388\">Welcome to <strong data-start=\"254\" data-end=\"282\">unitedsupportanimals.org<\/strong> (the \u201cSite\u201d). The Site is owned and operated by <strong data-start=\"331\" data-end=\"357\">United Support Animals<\/strong> (\u201cUSA,\u201d \u201cwe,\u201d \u201cus,\u201d or \u201cour\u201d).<\/p>\n<p data-start=\"390\" data-end=\"645\">By accessing or using the Site, you agree to be bound by these Terms and Conditions (\u201cTerms\u201d) without modification. If you do not agree, you must discontinue use of the Site. Continued use constitutes acceptance of the most current version of these Terms.<\/p>\n<p data-start=\"647\" data-end=\"828\">The Site operates as an e-commerce platform and provides services related to Emotional Support Animal (\u201cESA\u201d) and Psychiatric Service Dog (\u201cPSD\u201d) documentation and related products.<\/p>\n<hr data-start=\"830\" data-end=\"833\" \/>\n<h3 data-start=\"835\" data-end=\"855\">2. Definitions<\/h3>\n<p data-start=\"856\" data-end=\"953\">\u201cUser,\u201d \u201cYou,\u201d and \u201cYour\u201d are synonymous and refer to any individual accessing or using the Site.<\/p>\n<p data-start=\"955\" data-end=\"1053\">\u201cDocuments\u201d refers to digital ESA\/PSD approval or renewal documents issued by a licensed provider.<\/p>\n<hr data-start=\"1055\" data-end=\"1058\" \/>\n<h3 data-start=\"1060\" data-end=\"1076\">3. Privacy<\/h3>\n<p data-start=\"1077\" data-end=\"1275\">Your use of the Site is subject to USA\u2019s Privacy Policy, which governs how we collect, use, and safeguard your information. By using the Site, you consent to our data practices as described therein.<\/p>\n<hr data-start=\"1277\" data-end=\"1280\" \/>\n<h3 data-start=\"1282\" data-end=\"1326\">4. Electronic Communications; CAN-SPAM<\/h3>\n<p data-start=\"1327\" data-end=\"1563\">By visiting the Site or communicating with USA electronically, you consent to receive communications via email, SMS, phone, or the Site. Where permitted by law, USA may still send transactional or legally required notices.<\/p>\n<hr data-start=\"1940\" data-end=\"1943\" \/>\n<h3 data-start=\"1945\" data-end=\"2004\">5. TCPA Consent for Calls and Text Messages (SMS\/MMS)<\/h3>\n<p data-start=\"2005\" data-end=\"2371\">By providing your mobile number and opting in (including via checkbox, web form, short code, or similar mechanism), you expressly consent to receive recurring automated and\/or prerecorded calls and text messages from <strong data-start=\"2222\" data-end=\"2248\">United Support Animals<\/strong>, its affiliates, or service providers acting on its behalf, which may be sent using an automatic telephone dialing system.<\/p>\n<p data-start=\"2373\" data-end=\"2408\">These communications may include:<\/p>\n<ol data-start=\"2409\" data-end=\"2604\">\n<li data-start=\"2409\" data-end=\"2506\">\n<p data-start=\"2412\" data-end=\"2506\">Transactional\/service messages (account updates, verification, renewal and reminder notices)<\/p>\n<\/li>\n<li data-start=\"2507\" data-end=\"2604\">\n<p data-start=\"2510\" data-end=\"2604\">Marketing\/promotional messages (offers, discounts, product announcements, educational content)<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"2606\" data-end=\"2634\">You acknowledge and agree:<\/p>\n<ul data-start=\"2635\" data-end=\"3275\">\n<li data-start=\"2635\" data-end=\"2682\">\n<p data-start=\"2637\" data-end=\"2682\">Consent is <strong data-start=\"2648\" data-end=\"2655\">not<\/strong> a condition of purchase.<\/p>\n<\/li>\n<li data-start=\"2683\" data-end=\"2740\">\n<p data-start=\"2685\" data-end=\"2740\">Message and data rates may apply; frequency may vary.<\/p>\n<\/li>\n<li data-start=\"2741\" data-end=\"2922\">\n<p data-start=\"2743\" data-end=\"2922\">You may opt out of marketing texts at any time by replying <strong data-start=\"2802\" data-end=\"2810\">STOP<\/strong> (you will receive one final confirmation message). User Accounts<\/h3>\n<p data-start=\"3422\" data-end=\"3607\">If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. Accounts may not be transferred.<\/p>\n<p data-start=\"3609\" data-end=\"3746\">USA reserves the right, in its sole discretion, to refuse or cancel service, terminate accounts, or remove or modify content at any time.<\/p>\n<hr data-start=\"3748\" data-end=\"3751\" \/>\n<h3 data-start=\"3753\" data-end=\"3770\">7. Children<\/h3>\n<p data-start=\"3771\" data-end=\"3931\">USA does not knowingly collect personal information from children under 13. Users under 18 may use the Site only with the consent of a parent or legal guardian.<\/p>\n<hr data-start=\"3933\" data-end=\"3936\" \/>\n<h3 data-start=\"3938\" data-end=\"4007\">8. Third-Party Links and Services; Data Sharing for Fulfillment<\/h3>\n<p data-start=\"4008\" data-end=\"4212\">The Site may contain links to third-party websites or services. USA does not control and is not responsible for third-party content, accuracy, or practices. Inclusion of a link does not imply endorsement.<\/p>\n<p data-start=\"4214\" data-end=\"4420\">Certain services may be provided by independent healthcare practitioners or third-party vendors. By using such services, you consent to USA sharing information as necessary to fulfill the requested service.<\/p>\n<h4 data-start=\"4422\" data-end=\"4484\">Data Sharing with Third Parties for Service Fulfillment<\/h4>\n<p data-start=\"4485\" data-end=\"4802\">To deliver certain bundled features or add-ons, USA may share limited customer information (such as name, email, and pet details) with vetted third-party providers <strong data-start=\"4649\" data-end=\"4659\">solely<\/strong> to fulfill your purchase and enable related features, in compliance with applicable privacy laws (including the CCPA\/CPRA where applicable).<\/p>\n<p data-start=\"4804\" data-end=\"5160\">Third parties are contractually restricted to using this information only to provide services on our behalf and are prohibited from using it for unrelated purposes. USA does not sell your personal information for third-party marketing or advertising purposes. You may request access, correction, or deletion of your data as described in our Privacy Policy.<\/p>\n<hr data-start=\"5162\" data-end=\"5165\" \/>\n<h3 data-start=\"5167\" data-end=\"5216\">9. Intellectual Property and Acceptable Use<\/h3>\n<p data-start=\"5217\" data-end=\"5347\">You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for lawful purposes only.<\/p>\n<p data-start=\"5349\" data-end=\"5645\">All content on the Site, including text, graphics, logos, images, software, and compilations, is owned by USA or its licensors and protected by intellectual property laws. Feedback<\/h3>\n<p data-start=\"5735\" data-end=\"5926\">Any submissions made by you to USA, including comments, questions, suggestions, or materials (\u201cFeedback\u201d), regardless of method of submission, are deemed non-confidential and non-proprietary.<\/p>\n<p data-start=\"5928\" data-end=\"6261\">You hereby irrevocably assign to United Support Animals all right, title, and interest in such Feedback. USA may use, reproduce, disclose, distribute, and otherwise exploit the Feedback, in whole or in part, without attribution or compensation, for any lawful purpose, including product and service development, marketing, and sales.<\/p>\n<p data-start=\"6263\" data-end=\"6352\">USA is under no obligation to use any Feedback, and you have no right to compel such use.<\/p>\n<hr data-start=\"6354\" data-end=\"6357\" \/>\n<h3 data-start=\"6359\" data-end=\"6407\">11. ESA Program Highlights (Informational)<\/h3>\n<p data-start=\"6408\" data-end=\"6468\">Unless otherwise disclosed at checkout or required by law:<\/p>\n<ul data-start=\"6469\" data-end=\"6769\">\n<li data-start=\"6469\" data-end=\"6520\">\n<p data-start=\"6471\" data-end=\"6520\">Documentation may cover up to <strong data-start=\"6501\" data-end=\"6517\">two (2) pets<\/strong>.<\/p>\n<\/li>\n<li data-start=\"6521\" data-end=\"6584\">\n<p data-start=\"6523\" data-end=\"6584\">ESA services are generally available for <strong data-start=\"6564\" data-end=\"6581\">dogs and cats<\/strong>.<\/p>\n<\/li>\n<li data-start=\"6585\" data-end=\"6666\">\n<p data-start=\"6587\" data-end=\"6666\">Documentation is issued by licensed healthcare professionals where permitted.<\/p>\n<\/li>\n<li data-start=\"6667\" data-end=\"6769\">\n<p data-start=\"6669\" data-end=\"6769\">ESA\/PSD documents may be valid for <strong data-start=\"6704\" data-end=\"6726\">up to one (1) year<\/strong> and may require renewal to remain current.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"6771\" data-end=\"6942\">USA cannot compel third parties to comply with federal or state laws. We encourage users to understand applicable rules and to advocate for their rights where appropriate.<\/p>\n<hr data-start=\"6944\" data-end=\"6947\" \/>\n<h3 data-start=\"6949\" data-end=\"6994\">12. Warranties, Advice, or Legal Claims<\/h3>\n<p data-start=\"6995\" data-end=\"7235\">USA provides access or referrals to independent licensed providers. USA does not provide legal advice, medical advice, diagnosis, or treatment. Site content is for informational purposes only and is not a substitute for professional advice.<\/p>\n<p data-start=\"7237\" data-end=\"7345\">USA is not a medical clinic, law firm, or substitute for an attorney or licensed mental health professional.<\/p>\n<hr data-start=\"7347\" data-end=\"7350\" \/>\n<h3 data-start=\"7352\" data-end=\"7377\">13. Indemnification<\/h3>\n<p data-start=\"7378\" data-end=\"7742\">You agree to indemnify, defend, and hold harmless USA, its officers, directors, employees, agents, and affiliates from any claims, losses, liabilities, damages, costs, or expenses (including attorneys\u2019 fees) arising from your use of the Site, violation of these Terms, violation of law, infringement of third-party rights, or actions or behavior of your animal(s).<\/p>\n<p data-start=\"7744\" data-end=\"7926\">You understand you assume all risks (including emotional or physiological risks) related to accessing or using the Site, services, content, employees, agents, providers, or partners.<\/p>\n<hr data-start=\"7928\" data-end=\"7931\" \/>\n<h3 data-start=\"7933\" data-end=\"7995\">14. Disclaimer of Warranties and Limitation of Liability<\/h3>\n<p data-start=\"7996\" data-end=\"8121\">The Site and all information, products, and services are provided \u201cas is\u201d and \u201cas available,\u201d without warranties of any kind.<\/p>\n<p data-start=\"8123\" data-end=\"8423\">To the maximum extent permitted by law, USA disclaims all warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. USA shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Site.<\/p>\n<p data-start=\"8425\" data-end=\"8622\">Nothing in this section limits liability that cannot be limited under applicable law (including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).<\/p>\n<hr data-start=\"8624\" data-end=\"8627\" \/>\n<h3 data-start=\"8629\" data-end=\"8692\">15. Refunds, Cancellations, Returns, and Money-Back Terms<\/h3>\n<p data-start=\"8693\" data-end=\"8808\">This section applies except where otherwise required by law (including additional California rights in Section 16).<\/p>\n<h4 data-start=\"8810\" data-end=\"8857\">15.1 Provider Denial (Evaluation Denied)<\/h4>\n<p data-start=\"8858\" data-end=\"9168\">If your evaluation is denied by the licensed provider for any reason, you will receive a <strong data-start=\"8947\" data-end=\"8962\">100% refund<\/strong> of the amount paid for the ESA request, and USA may cover the provider evaluation fee as described at checkout. Denial refunds are processed back to the original payment method within <strong data-start=\"9147\" data-end=\"9167\">30 business days<\/strong>.<\/p>\n<h4 data-start=\"9170\" data-end=\"9200\">15.2 Approved Documents<\/h4>\n<p data-start=\"9201\" data-end=\"9547\">If your ESA\/PSD order has been approved and you request a refund within <strong data-start=\"9273\" data-end=\"9284\">30 days<\/strong> of purchase, you may be eligible for a refund of the Documents, subject to the conditions disclosed at checkout and any return requirements for physical items (if applicable). If a hard copy was mailed, you may be required to return it before a refund is issued.<\/p>\n<h4 data-start=\"9549\" data-end=\"9575\">15.3 Physical Goods<\/h4>\n<p data-start=\"9576\" data-end=\"9842\">Non-custom physical goods (such as tags, leashes, vests, and similar items) may be returned within <strong data-start=\"9675\" data-end=\"9686\">30 days<\/strong> in new, unused condition with original packaging for a full refund. Customer is responsible for return shipping unless the item was defective or incorrect.<\/p>\n<p data-start=\"9844\" data-end=\"9974\">Customized items (including customized ID cards or printed certificates) are non-returnable and non-exchangeable unless defective.<\/p>\n<h4 data-start=\"9976\" data-end=\"10027\">15.4 No Refund for Third-Party Noncompliance<\/h4>\n<p data-start=\"10028\" data-end=\"10344\">If a housing provider, hotel, rideshare, store, or other entity refuses to comply with applicable laws or guidelines, USA cannot control that entity\u2019s actions and generally cannot offer refunds solely on that basis, except as otherwise required by law or expressly described in a separate guarantee purchased by you.<\/p>\n<h4 data-start=\"10346\" data-end=\"10383\">15.5 General Cancellation Rule<\/h4>\n<p data-start=\"10384\" data-end=\"10502\">Except where otherwise required by law, cancellations made after <strong data-start=\"10449\" data-end=\"10471\">60 days of service<\/strong> are not eligible for a refund.<\/p>\n<hr data-start=\"10504\" data-end=\"10507\" \/>\n<h3 data-start=\"10509\" data-end=\"10551\">16. These provisions supersede any conflicting terms elsewhere in this Agreement.)<\/em><\/p>\n<h4 data-start=\"10694\" data-end=\"10763\">16.1 Emotional Support Animal Requirements (AB 468 Compliance)<\/h4>\n<p data-start=\"10764\" data-end=\"10904\">For California residents, ESA\/PSD documentation facilitated through USA complies with California Health &amp; Safety Code \u00a7 122318, including:<\/p>\n<ul data-start=\"10905\" data-end=\"11288\">\n<li data-start=\"10905\" data-end=\"10991\">\n<p data-start=\"10907\" data-end=\"10991\">Issued only by a California-licensed health care practitioner acting within scope.<\/p>\n<\/li>\n<li data-start=\"10992\" data-end=\"11061\">\n<p data-start=\"10994\" data-end=\"11061\">A therapeutic relationship of at least 30 days prior to issuance.<\/p>\n<\/li>\n<li data-start=\"11062\" data-end=\"11106\">\n<p data-start=\"11064\" data-end=\"11106\">A clinical evaluation to determine need.<\/p>\n<\/li>\n<li data-start=\"11107\" data-end=\"11218\">\n<p data-start=\"11109\" data-end=\"11218\">Letters include practitioner name, license number, license type, licensing jurisdiction, and issuance date.<\/p>\n<\/li>\n<li data-start=\"11219\" data-end=\"11288\">\n<p data-start=\"11221\" data-end=\"11288\">Notice regarding Penal Code \u00a7 365.7 (fraudulent misrepresentation).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"11290\" data-end=\"11315\">Additional disclosures:<\/p>\n<ul data-start=\"11316\" data-end=\"11528\">\n<li data-start=\"11316\" data-end=\"11414\">\n<p data-start=\"11318\" data-end=\"11414\">ESA documentation is not government certification and does not grant ADA public access rights.<\/p>\n<\/li>\n<li data-start=\"11415\" data-end=\"11478\">\n<p data-start=\"11417\" data-end=\"11478\">ESA tags\/vests\/IDs\/certificates are convenience items only.<\/p>\n<\/li>\n<li data-start=\"11479\" data-end=\"11528\">\n<p data-start=\"11481\" data-end=\"11528\">ESAs do not receive the rights of service dogs.<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"11530\" data-end=\"11583\">16.2 Automatic Renewal and Subscriptions (ARL)<\/h4>\n<p data-start=\"11584\" data-end=\"11782\">USA discloses pricing, billing frequency, renewal terms, recurring charges, and cancellation methods before purchase. Enrollment requires affirmative consent. You remain responsible for your own attorney fees and expert costs unless otherwise required by law or awarded by the arbitrator. Governing Law and Venue (Non-Arbitration Matters)<\/h3>\n<p data-start=\"17092\" data-end=\"17270\">These Terms are governed by the <strong data-start=\"17124\" data-end=\"17151\">Federal Arbitration Act<\/strong>, <strong data-start=\"17153\" data-end=\"17168\">Florida law<\/strong>, and applicable U.S. federal law, without regard to conflict-of-law rules.
